What does the new Renters’ Rights Bill mean for landlords?

More details of the government’s proposed Renters Rights Bill have been made public. It is anticipated that Parliament will consider the bill in the autumn.

“Legislation will be introduced to give greater rights and protections to people renting their homes, including ending no fault evictions and reforming grounds for possession,” as stated in a brief mention of the Bill in this week’s King’s Speech.

What is the purpose of the Bill?

  • Abolishing the possibility of arbitrary evictions by repealing Section 21’s “no fault evictions,” which will also improve tenant security and stability. Expanded and unambiguous possession grounds will be implemented to enable landlords to retrieve their properties as needed. 
  • Enhancing renters’ rights and protections; for instance, we’ll give them the ability to oppose rent hikes intended to evict them covertly and enact new legislation to put an end to the practice of landlords and letting agencies engaging in rental bidding wars. 
  • Granting tenants the ability to seek a pet, a request that landlords are obliged to entertain and cannot unjustly reject. If necessary, landlords will have the option to obtain insurance to cover any potential harm caused. 
  • Addressing the issue of subpar housing by enforcing a Decent housing Standard on the private rental market to guarantee that residences are risk-free, secure, and safe. 
  • Implementing “Awaab’s Law” in the industry, which establishes precise legal requirements on the amount of time that private landlords have to make their properties safe where they pose significant risks. 
  • Assembling essential data for councils, tenants, and landlords in a digital database for the private rental sector. Information will be available for tenants to use when making decisions about starting new leases. Tenants and landlords alike will have certainty as landlords can promptly comprehend their responsibilities and prove compliance. The database will enable councils to focus enforcement efforts where they are most needed. 
  • A new private rented sector ombudsman service that will provide fair, impartial, and binding resolution to both landlords and tenants and reduce the need to go to court will support speedier, less expensive resolution of disputes and prevent them from escalating to costly court proceedings. 
  •  Prohibiting landlords from discriminating against tenants who are eligible for public assistance or who have children when deciding whether to rent out their property. This ensures that no family faces prejudice and is turned away from a place to live when they need it.  
  • Enhancing the enforcement capabilities of local authorities. Councils will find it simpler to detect and punish dishonest landlords and remove problematic actors from the rental market thanks to new investigative powers. 

The policies included in the Renters Rights Bill are not new; they were either discussed during the election campaign or included in Labour’s manifesto, or they were included in the Renters Reform Bill. This information was disclosed in the briefing notes for the King’s Speech.

A little shift in focus has been made in favour of tenants’ rights, consistent with the King’s Speech’s mention of workers’ rights.
